Final Agreements & Signature

(6) Full balance is due and payable at the final planning meeting (face to face or via phone) NO LATER THAN one week before event date. DJ or Photo booth attendant will not set up for event until all payments have been cleared. *

(7) Any cancellation must be in writing sixty (60) days prior to event. If the event is cancelled sixty (60) or more days prior to event, the retainer fee and all monies paid in advance will be forfeited or can be applied to another date and/or event within the calendar year of the original contract date. Cancellation less than sixty (60) days prior to event will require full payment of contract price to be due one week before the event date. Rescheduled event must be scheduled within calendar year of the original contract date. Rescheduled events are subject to availability. If the event is cancelled by DME Services & Rentals, LLC client will receive a full refund of all monies paid to the company. *

(8) If event(s) is/are outdoors the client shall provide adequate shelter from the sun and/or inclement weather (including rain, heat, hail, or snow) for all equipment. The equipment (including speakers, Computer systems, mixers, external hard drives, lighting, microphones, and any other equipment brought to the event by a DME Services & Rentals representative) is strictly off limits to anyone other than the company’s representatives. The Client is responsible for compliance with this policy by their guests. *

(9) If DME Services & Rentals, LLC must employ the services of an attorney to enforce the provisions of this contract, the Client agrees to pay all costs of enforcement including a reasonable attorney's fee in the event a judgment is found in favor of DME Services & Rentals, LLC. Any action arising out of this contract shall be brought only in Duval County and the Client hereby waives venue to any other county. If this agreement is litigated for any reason the amount rewarded to either party shall not exceed the original cost of DME Services & Rentals services for this event as indicated above in the "Total Amount for Service" line (excluding any fees or court costs that may be applied). *

(10) Client agrees that all modifications to any portion of this contract by the Client must be submitted in writing, be approved in writing and must be initialed by DME Services & Rentals, LLC or such modifications are invalid and nonbinding. This contract is binding upon all parties, executors, administrators, and personal representatives of the Client and DME Services & Rentals, LLC. *
